You license only the repos you choose, and only code you own or hold the rights to license: R&D, internal tools, and projects that have wound down. Client work, NDAs, and confidential data stay out of it.

Your own process sells, and client deliverables usually don’t
An agency or consultancy holds two kinds of records: how the firm works, and what it made for clients. The first is yours to license. The second belongs, at least in part, to the client, and Telegraph says third-party information “requires additional review and may need to be excluded.” Miro Advisory says client data stays out unless the rights to it are clear.
The firm’s own records are where to start:
- Proposals, playbooks, templates and SOPs, in documents and wikis.
- Pipeline and account history in a CRM such as HubSpot.
- Project boards in Jira or Linear, with the status changes that show how work was run.
- Internal Slack or Teams and email, scoped to leave out client channels you can’t license.
Read each client contract for who owns the deliverables and what the confidentiality terms cover. The rights checklist lists what else to check.
Code you built for yourself can be licensed
Pangea’s page for agencies takes “R&D, internal tools, and projects that have wound down”, and keeps “client work, NDAs, and confidential data” out. The license is non-exclusive, so the agency keeps using the code. The worth calculator prices your own repositories at Pangea’s rates.
Staffing firms are on Scale’s list too
Scale lists staffing and recruiting next to business and professional services. A staffing firm’s placement records hold candidates’ personal details, so expect them to be de-identified before anything is shared. Scale says employee and customer identities never leave your company.
Size floors start at 20 to 40 people
micro1 asks for 30 or more full-time employees, Mode for 30, and Scale prefers 40. Miro Advisory works with roughly 20 to 700. Pangea has no size floor for code.

Questions owners ask
Can a marketing agency sell client data to AI companies?
Only what the agency has the right to license. Read each client contract for who owns the deliverables and what the confidentiality terms cover, and leave out anything they don't allow.
Can a consultancy license code it wrote for clients?
Not through Pangea, which keeps client work out. Code the firm wrote for itself, such as internal tools and R&D, can be licensed.
