An asterisk marks our reading of the text rather than its words; the fact's note says what it rests on. "The terms don't say" means every contract, AI page and data processing addendum was read. Not legal advice.

Who owns the data the customer puts in?

- Headline Every plan covers all customer data and materials

'Customer Data' means all information you submit or collect via the Subscription Service.

Same article: 'By default, the setting will be turned on.' Examples of HubSpot's own models: CRM deduplication, search, business card scanner, email segmentation, spam detection, deal-close prediction; some are trained 'on data across many customer accounts'. 'It is not possible to delete previously used data from trained models. Opt-outs will only apply moving forward.' Accounts with Sensitive Data on are opted out and cannot opt in. Same on every plan (article: 'All products and plans').
- Headline Every plan covers all eligible customer data
Generative: opt-out*
We may also use Customer Data to train our AI models in compliance with our obligations under the Agreement.
HubSpot Customer Terms of Service (General Terms) (terms), read 2026-10-22 · link to this fact
Reading: General Terms 5.3.1 lets HubSpot train 'our AI models' with no carve-out for generative models, and the opt-out ('You may opt out of having your Customer Data used for this purpose by updating your settings in your HubSpot account') covers all of them. No HubSpot page says whether HubSpot itself trains generative models on customer data; the third-party providers behind its generative features (e.g. OpenAI) may not train on it (see detail fact).
- Detail Every plan covers customer data sent to AI service providers
Generative: no
Importantly, we do not permit the AI service providers we engage to provide the Subscription Services to use customer data for model training, and we enforce zero data retention wherever possible.
HubSpot AI Cloud Infrastructure | Frequently Asked Questions (ai policy), read 2026-10-22 · link to this fact
Covers third-party providers only (OpenAI and others listed on the Sub-Processors page), not HubSpot's own models. The AI Trust page says the same: 'We also have strong contractual guarantees that they do not train their models on HubSpot customer data.'
- Supporting Every plan covers all customer data
Other models: opt-out
You can control whether your data is used to improve HubSpot's models, and opting out is always available.

Does the vendor keep a right to use it aggregated, de-identified or as usage data?
Reserved · covers usage data about how users interact with the product
- Headline Every plan covers usage data about how users interact with the product
Reserved
When we share statistical information externally in this way, the data will be aggregated and we will not identify individual users or customers.
HubSpot Privacy Policy (privacy policy), read 2026-10-22 · link to this fact
Privacy Policy 2.3. Preceding sentences: HubSpot uses 'usage data about how you or your users interact with our product and services to develop and improve our products' and 'may publish data about how our product and services are being used across our customer base.' The General Terms have no separate aggregated-data clause; the DPA's CCPA section points to the Privacy Policy's 'Usage Data' section.
- Detail Every plan covers website visitor data from the HubSpot tracking code
Reserved
We may use data collected through the HubSpot Tracking Code, which may include Personal Data such as IP addresses and other online identifiers ("Website Data") to provide, maintain, append, improve, enhance, and develop our commercial dataset and Subscription Services.

Article is 'Available with ... All products and plans'; 'Export permissions are required to export records' (a user permission set by admins, so who=admin). Formats from the article's file limits (CSV, XLSX, XLS). scope=all is a reading of the 'Export your content and data' index, which lists an export path for every data type; activities (calls, notes) and inbox conversations go through the Engagements and Conversations APIs, hence api. - Detail Every plan covers workflow action logs
180 days, older data hidden, not deleted
180 days: all workflows action log data will be stored.
Export your content and data (help article), read 2026-10-22 · link to this fact

- Headline Starter, Professional, Enterprise covers all customer data

Product Specific Terms 5.1.1 (Sales, Service, Content, Data Hub and others). But canceling a paid plan first drops the account to the free tools (General Terms 4.5: 'If your paid subscription is terminated or expires, we will continue to make available to you our Free Services'), so records stay reachable until the free account is deleted or ended. Marketing Hub Professional and Enterprise have a 30-day window (product fact).
- Headline Marketing Hub Professional and Enterprise covers all customer data
30 days to export
For Marketing Hub Professional - Marketing Contacts and for Marketing Hub Enterprise - Marketing Contacts, if you make a written request within thirty (30) days after termination or expiration of your subscription, we will provide you with temporary access to the Subscription Service to retrieve, or we will provide you with copies of, all Customer Data then in our possession or control.

90 days to export*
You then have 90 days to reactivate the account before it's purged and can't be recovered.
Recover your inactive HubSpot account (help article), read 2026-10-22 · link to this fact
Reading: a free account deactivated for inactivity (after 120 days) can be reactivated for 90 days, which restores access and so export; after that it is purged.
What the read couldn't settle
- Generative training by HubSpot itself is a reading of General Terms 5.3.1 ('our AI models'); no page separates HubSpot's own generative models. HubSpot Model Cards and the AI Trust FAQ page (trust center) were not fetched.
- Plans are per Hub (Marketing, Sales, Service, Content, Data, Revenue); grouped as Free, Starter, Professional, Enterprise. after_cancel splits by product: only Marketing Hub Professional and Enterprise get a 30-day retrieval window.
- Paid cancel drops the account to free tools (records stay), so the 'no access after termination' headline bites only when the whole agreement or free account ends; how the table should show this needs a call.
- Deletion timing after termination is not given in days: the DPA defers to the Product Specific Terms and HubSpot's 'deletion practices' for backups.
- Export who=admin is a reading of 'Export permissions are required'; any user can hold that permission if a Super Admin grants it. Free-plan API access for activity and inbox export not checked.
- legal.hubspot.com/hubspot-ai-terms returns 404; HubSpot's AI terms sit in Product Specific Terms section 7 (listed as hubspot-pst).
